Czech solar tax could be extended into 2014

December, 2012: Czech Industry and Trade Minister Martin Kuba said that an existing tax on photovoltaic (PV) power plants could be extended through 2014.

The so-called solar tax is due to expire at the end of 2013; however, in an interview with Czech Television (CT), Kuba revealed that the tax could be extended by another year for some PV power plants. The minister told CT that the government will consider applying the solar tax to certain PV power plants in 2014, but “I don’t think it will be applied across the board.” Details on how the government will decide which power plants continue to be taxed has yet to be determined; however, Kuba said the government will ensure that all PV projects make a return on investment. The Czech Republic introduced a 26% retroactive tax on income generated by PV power plants in December 2010. The tax applies to solar installations greater than 30 kW in size that were commissioned in 2009 or 2010. Investors filed legal complaints against the retroactive nature of the tax, but the Czech Constitutional Court recently ruled that the Czech government acted within its rights when it implemented the tax.
